1. If you do not have a will, the state in which you live in will write one for you. This means your assets may not be passed down to the right person

3. Save your family time and stress. Without a will, estate administration will be much slower, the costs of administration will be higher and the personal representative will not be able to sell real estate without a court order.

4. The court will appoint who the guardian of your children will be without your say or input. The people the courts may decide are fit guardians for your children may be the last person you would have chosen.

5. If you have young children with an ex-spouse, who would need a guardian and a trust, then you need a will. If you have children under the age of 18, your assets could end up with your ex-spouse. A will allows you to leave your assets to your children in a trust rather than giving it to them out right. This will prevent your children's share of the assets from being passed on to the ex-spouse who may be able to finagle the money prior to the child becoming 18.

6. With a will, you can assign a trust that will allow your assets to be distributed to your children the ages you feel appropriate. For example: If your children were to receive their inheritance at the age of 18, they may not be using the funds wisely. Rather then using such funds for college tuition or purchasing a home they may carelessly use it to buy a motorcycle, take friends on a trip or support a girlfriend/boyfriend.

7. You may not approve of the even distribution of your assets to your children decided by the courts. For example: You may have one child who has a college degree and is making a very good living while another is just getting out of high school in need for tuition.

8. There may be sentimental heirlooms that you want to leave to a specific people.

9. Your family business could be passed on to family members that do not get along. Without naming a specific person or persons to inherit your business, your children from a previous marriage could inherit the business that currently supports your spouse leaving he/she with no control over the business.

10. The last portrait you want to paint your family is one that says, "I don't care" If you die without a will, you're inviting your loved ones to argue over what sentimental items or valued possessions you may have left behind. Often family members fight over these issues and hold grudges for years. Take that burden off your loved ones.
